Nyctof, Inc. ("Nyctof," "we," "us," or "our") operates the Nyctof mobile application and the website nyctof.com (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service.
By accessing or using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.
2. Information We Collect
Information you provide to us:
- Account information: name, email address, username, profile photo, and date of birth
- Application information: data submitted through the membership application process
- Profile information: bio, interests, and other details you choose to share
- Communications: messages sent through the Service, support requests, and feedback
Information collected automatically:
- Location data: approximate location based on GPS, Wi-Fi, or cell tower data, used to show nearby venues and enable presence features. Location coordinates are fuzzed to approximately 200 meters for privacy.
- Device information: device type, operating system, unique device identifiers, and mobile network information
- Usage data: pages visited, features used, time spent in the app, and interaction patterns
- Analytics data: collected through third-party analytics services (PostHog, Sentry) to improve the Service
3. How We Use Your Information
We use the information we collect to:
- Provide, maintain, and improve the Service
- Process and review membership applications
- Display nearby venues and community members based on your location
- Enable social features such as community discovery, messaging, and connection requests
- Send notifications related to your account, including application status updates
- Monitor and analyze usage trends to improve user experience
- Detect, prevent, and address fraud, abuse, or security issues
- Comply with legal obligations
4. Location Data
Location data is central to how Nyctof works. We want to be transparent about how we handle it:
- Your precise location is never shared with other users. All coordinates displayed on the map are fuzzed to an approximately 200-meter grid.
- Location presence data has a 4-hour time-to-live (TTL) and is automatically deleted after expiration.
- You can disable location sharing at any time through Ghost Mode or your device settings.
- In emergency situations (SOS feature), your precise location may be shared with your designated emergency contacts.
5. Sharing Your Information
We do not sell your personal information. We may share your information in the following circumstances:
- With other users: Your profile information, approximate location, and activity status may be visible to other approved members, subject to your privacy settings and tier level.
- Service providers: We work with third-party companies that help us operate the Service, including cloud hosting (Supabase), analytics (PostHog), error tracking (Sentry), email delivery (Resend), and mapping services (Mapbox).
- Legal requirements: We may disclose information if required by law, legal process, or governmental request.
- Safety: We may share information when we believe it is necessary to protect the safety of our users or the public.
6. Data Security
We implement industry-standard security measures to protect your information, including encryption in transit and at rest, row-level security policies on our database, and regular security reviews. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
7. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Service. Location presence data is automatically deleted after 4 hours. If you delete your account, we will delete your personal information within 30 days, except where we are required to retain it for legal or compliance purposes.
8. Your Rights and Choices
Depending on your jurisdiction, you may have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your account and personal information
- Opt out of marketing communications
- Disable location sharing through Ghost Mode or device settings
- Export your data in a portable format

9. Children's Privacy
The Service is not intended for individuals under the age of 19 in the province of Ontario, or the applicable age of majority in your jurisdiction. We do not knowingly collect personal information from minors. If we become aware that we have collected information from a minor, we will take steps to delete it promptly.
10. International Data Transfers
Nyctof is based in Ontario, Canada. If you access the Service from outside Canada, your information may be transferred to and processed in Canada or other jurisdictions where our service providers operate. By using the Service, you consent to such transfers.
11. Third-Party Services
The Service may contain links to third-party websites or integrate with third-party services. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you interact with.
12. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Service and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised policy.
